Section 8 HAP properties and FHA financing: sizing, renewals and approvals
A property with a project-based Section 8 HAP contract on at least 90% of its units and 15 or more years left counts as affordable for FHA purposes, so a 223(f) can lend up to 90% of value at 1.11x, and a 223(a)(7) can size at 95% of income. The HAP renewal, rent study and any prepayment approval must line up with the FHA application.
Why Section 8 changes the loan
A long project-based HAP contract is stable, government-paid income, and HUD’s underwriting gives it credit. Under MAP Guide 3.1.12, a property qualifies as affordable on the Section 8 test when a HAP contract covers 90% of the units with at least 15 years remaining. That puts it in HUD’s best sizing tier.
| Program | Sizing for a 90%+ assisted property | Source |
|---|---|---|
| 223(f) purchase or refinance | Up to 90% of value, 1.11x DSCR, 3% minimum vacancy | ML 2025-03; MAP Appendix 3 |
| 221(d)(4) substantial rehab | Up to 90% of cost, 1.11x DSCR | ML 2025-03 |
| 223(a)(7) streamline | Lesser of original principal, existing debt plus costs, or 95% of NOI (for more than 90% PBRA with a term over 15 years after endorsement) | MAP 3.8.3 |
A 223(a)(7) sized at 95% of income, about a 1.05x coverage, is among the most generous ratios in HUD’s multifamily programs (Section 213 co-op streamlines get the same).
Lining up the HAP renewal
MAP Guide 14.6 puts the burden on the borrower and lender to make sure HAP renewal terms under the Section 8 Renewal Policy are satisfied before submission or initial endorsement. The timing rules:
- Send the renewal and any rent adjustment request to the Performance Based Contract Administrator at least 60 days before the firm application; 120 days is better.
- Keep rents fresh. The rent comparability study rents and the appraiser’s rents must be set within 180 days of firm commitment issuance, or updated.
- Separate the experts. If the owner commissions the rent comparability study, the same firm cannot do the appraisal; if the lender commissions it, it can.
- Budget-based rents. The lender and owner agree a preliminary debt service figure to put in the proposed budget, which may need amending after final underwriting.
- Prepayment approvals. If the existing FHA loan needs HUD’s approval to prepay, send that request to HUD headquarters well before the firm application (MAP 14.6.E, citing ML 2018-07).
HUD’s underwriter checks that the rents in the renewal request are supported by the study and reflected in the lender’s underwriting, and coordinates with asset management so the renewal, rent increase and any waivers are approved in time.
Which rents size the loan
- Value (Criterion 3) uses market rents, except on a first refinance of a Section 202 loan or a RAD deal.
- Debt service (Criterion 5): if the HAP contract is short or subject to mark-down to market, HUD uses the lower of market rents or HAP rents.
- Long above-market contracts: the underwriter may size two tranches, an A piece at market rents over the full loan term and a B piece on the difference between market and HAP rents over the remaining contract term.
Many renewed contracts adjust rents each year by HUD’s operating cost adjustment factors (OCAFs); the 2026 factors were published February 3, 2026 (91 FR 4934).
Selling a Section 8 property
A buyer of a property with an FHA loan and a HAP contract goes through two HUD consents: the Transfer of Physical Assets for the loan, and the assignment of the HAP contract. Under 24 CFR 200.218 the HAP assignment is itself a triggering event for previous participation review. The buyer takes on the contract’s terms and any use restrictions along with the regulatory agreement.
After closing
- Distributions. Properties with project-based Section 8 are excluded from ML 2022-16’s monthly distribution option; see surplus cash. Some older assisted properties are limited-dividend or nonprofit, with tighter distribution limits and residual receipts accounts.
- Prepayment. Prepaying a loan on an assisted property can need HUD approval regardless of the 223(f) statute; see HUD prepayment.
- Data. HUD publishes every active assistance contract, with expiration dates and assisted unit counts, in its Multifamily Assistance and Section 8 Contracts database, updated monthly.
Public housing converting to Section 8 follows the RAD rules; see RAD and HUD.

Short answers
Can I refinance a Section 8 property with a HUD loan?
Yes. Properties with project-based Section 8 contracts use FHA 223(f) for refinances and acquisitions, 223(a)(7) to streamline an existing FHA loan, and 221(d)(4) for substantial rehab. With a HAP contract on at least 90% of units and at least 15 years remaining, HUD treats the property as affordable and sizes 223(f) at up to 90% of value and 1.11x coverage.
Does the HAP contract need to be renewed before the FHA loan closes?
Under MAP Guide 14.6, the renewal terms under HUD's Section 8 Renewal Policy must be satisfied before application submission or initial endorsement. If the existing contract already has 15 or more years left from final endorsement, no renewal is needed to qualify for FHA insurance, although other programs such as RAD may have their own requirements.
Which rents does HUD use to size a loan on a Section 8 property?
Value is based on market rents. For the debt service test, if the HAP contract is short or subject to mark-down to market, HUD uses the lower of the appraiser's market rents or the HAP rents. If the HAP rents are above market for a long term, the loan can be split into an A piece sized on market rents over the full term and a B piece sized on the above-market portion over the remaining HAP term.
What is an assignment, assumption and amendment of a Section 8 HAP contract?
When a property with a project-based HAP contract is sold, the seller assigns the contract to the buyer, who assumes its obligations, usually with amendments to reflect the new owner. HUD must consent, and under 24 CFR 200.218 a request to assign a HAP contract is a triggering event for previous participation review of the buyer's controlling participants. It runs alongside the TPA if an FHA loan is being assumed.
Can a Section 8 property take monthly surplus cash distributions?
No. Mortgagee Letter 2022-16, which allows up to monthly distributions on newer FHA loans, is limited to properties not subject to a project-based Section 8 HAP contract or a HUD-held note. Section 8 properties follow the annual, or semi-annual where allowed, schedule in their regulatory agreement and HAP contract.
